O presente artigo faz uma reflexão sobre a esfera pública de Jünger Habermas, como uma via de abertura para o debate em todas as dimensões. Objetiva-se apresentar neste trabalho, como o conceito de esfera pública habermasiana pode justificar a atuação do Tribunal de Contas como mecanismo de fiscalização, controle e de construção do mérito administrativo, com foco, nesta pesquisa, para a atuação administrativa nos procedimentos licitatórios. Defende-se que o Tribunal de Contas deve atuar no controle de processos licitatórios, a fim (...) de possibilitar discussões amplas e abertas com os gestores públicos e com toda a sociedade, configurando verdadeira construção da esfera pública, possibilitando gestões ancoradas na moralidade, transparência e democráticas. A partir de tal pesquisa, conclui-se que a Lei nº 14.133, de 01 de abril de 2021, ao afastar o Tribunal de Contas para a terceira linha de defesa dos procedimentos licitatórios prejudica a esfera pública e, por outro lado, sua atuação pedagógica prevista na mesma legislação pode trazer vantagens para a mesma esfera pública. O procedimento metodológico utilizado é o dedutivo, pautada em pesquisa bibliográfica, adotando como marco teórico o conceito habermasiano de esfera pública. (shrink)

The growth of urban violence in Brazil, as in other countries, has led citizens to demand more severe and punitive measures to solve the problem of juvenile crime. One motion submitted to the Brazilian parliament, for instance, proposes to reduce the age of penal majority from 18 to 16 years. Our hypothesis is that popular opinions about this proposal are largely constrained by construal levels and psychological distance. Accordingly, we expect that the knowledge and proximity to the circumstances associated with (...) juvenile transgression will influence opinions about the proposal. To test this hypothesis, we evaluated how opinion against or for the proposal can be explained by psychological distance and moral development theory. We studied two samples, composed of people who do not have a deep experience with the subject and workers from a juvenile justice court. After collecting socio-demographic information from the subjects and their answer to moral dilemmas, the data was subjected to a multivariate analysis by multimodal logistic regression for socio-demographic characteristics, Kohlberg moral stages, and opinion on the reduction of APM as dependent variables. Our findings suggest that 1) opinion about the APM depends on psychological distance and 2) socioeconomic variables may influence the average construal level of adolescent transgressors in the public’s perspective. Targeted modifications of the human epigenome, epigenome editing (EE), are around the corner. For EE, techniques similar to genome editing (GE) techniques are used. While in GE the genetic information is changed by directly modifying DNA, intervening in the epigenome requires modifying the configuration of DNA, for example, how it is folded. This does not come with alterations in the base sequence (‘genetic code’). To date, there is almost no ethical debate about EE, whereas the discussions about GE are voluminous. (...) Our article introduces EE into bioethics by translating knowledge from science to ethics and by comparing the risks of EE with those of GE. We, first (I), make the case that a broader ethical debate on EE is due, provide scientific background on EE, compile potential use-cases and recap previous debates. We then (II) compare EE and GE and suggest that the severity of risks of novel gene technologies depends on three factors: (i) the choice of an ex vivo versus an in vivo editing approach, (ii) the time of intervention and intervention windows and (iii) the targeted diseases. Moreover, we show why germline EE is not effective and reject the position of strong epigenetic determinism. We conclude that EE is not always ethically preferable to GE in terms of risks, and end with suggestions for next steps in the current ethical debate on EE by briefly introducing ethical challenges of new areas of preventive applications of EE (III). This examination of a fundamental but often neglected aspect of the intellectual history of early modern Europe brings together philosophers, historians and political theorists from Great Britain, Canada, the United States, Australia, France and Germany. n the first part of the paper I will present Pritchard’s approach to Wittgenstein’s notion of hinge commitments, which is essential to his solution to the closure-based sceptical arguments. And, in the second par of the paper, I will raise some concerns that I have regarding Pritchard’s non-belief reading of the hinge commitments. In the third and final part, I make some concluding remarks regarding Pritchard’s overall strategy to solve the closure-based sceptical paradox.

On such a view, mind/brain identity statements can be justified by an inference to the best explanation (IBE) starting from the empirical premise of mind/brain correlations. We contend that Identity Theory cannot be based on such an abductive methodology. First, we argue that mind/brain identity statements cannot be justified by an IBE from correlations as it leads to the following dilemma : either correlations are trivial facts that cannot pretend to the status of explananda, or mind/brain identities must be admitted as brute facts, just like dualist laws. Second, we show that these identity statements can still be justified by an IBE starting from the premise of mental causation. Psychonarratology is an approach to the empirical study of literary response and the processing of narrative. It draws on the empirical methodology of cognitive psychology and discourse processing as well as the theoretical insights and conceptual analysis of literary studies, particularly narratology. The present work provides a conceptual and empirical basis for this interdisciplinary approach that is accessible to researchers from either disciplinary background. An integrative review is presented of the classic problems in narratology: the status of the narrator, events (...) and plot, characters and characterization, speech and thought, and focalization. For each area, Bortolussi and Dixon critique the state of the art in narratology and literary studies, discuss relevant work in cognitive psychology, and provide a new analytical framework based on the insight that readers treat the narrator as a conversational participant. Empirical evidence is presented on each problem, much of it previously unpublished. (shrink)

What is considered normal determines clinical practice in medicine and has implications at an individual level, doctor-patient relationship and health care policies. With the increase in medical information and technical abilities it is urgent to have a clear concept of normality in medicine so that crucial discussions can be held with unequivocal terms.The different meanings for normality were analyzed throughout the literature and grouped according to their relevance in the academic community in models, namely the Biostatistical Theory (BST), Health, Ideal, (...) Process and Biological advantage. The BST is the most established naturalistic approach, however normal variability can arguably constitute a problem. Health is similar and raises the question of setting the boundaries of pathology. Normality as an Ideal is an useful tool but is naturally unrealistic. As a Process it is comprehensible but is hard to frame for practical purposes. If considered as a Biological Advantage, seems intuitive but abnormality should tend to disappear.After, three examples were presented to discuss these models. They were Anemia, Psychiatric diseases and Psychopathy. In the case of Anemia the BST was applied and the arbitrary boundaries but with social impact were exposed. Psychiatric diseases was discussed under the process of self-organization and non-suffering ideal. With Psychopathy the boundaries of biological advantage are questioned.This review appeals to the importance of redesigning of the concept of normality in medicine according to current times and stresses the importance of integrating concepts such as variability and autonomy. “Moorean Dogmatist” responses to external world skepticism endorse courses of reasoning that many people find objectionable. This paper seeks to locate this dissatisfaction in considerations about epistemic responsibility. I sketch a theory of immediate warrant and show how it can be combined with plausible “inferential internalist” demands arising from considerations of epistemic responsibility. The resulting view endorses immediate perceptual warrant but forbids the sort of reasoning that “Moorean Dogmatism” would allow. A surprising result is that Dogmatism’s commitment to immediate epistemic (...) warrant isn’t enough to avoid certain standard arguments for skepticism about the external world. (shrink)

In Metaphysics Γ, Aristotle argues against those who seem to accept contradictions. He distinguishes between the Sophists, who deny the principle of non-contradiction through arguments, and the Natural Philosophers, whose physical investigations lead to the acceptance of objective contradictions. Heraclitus’ name appears throughout the discussion. Usually, he is associated with the discussion against the Sophists. In this paper, I explore how the discussion with the Natural Philosophers may illuminate both the interpretation of Heraclitus by Aristotle and Heraclitus’ own worldview. To (...) refute the Natural Philosophers, Aristotle proposes a general reconstruction of their reasoning. Roughly, relying on sensory evidence (A1), they see that the same thing changes from one opposite to another (A2). Such a change appears to characterize a generation out of non-being, which a Natural Philosopher does not accept (A3). To solve the problem, despite their different worldviews, Natural Philosophers hint at a state in which opposites co-occur, characterizing an objective contradiction (C). Looking at the discussion in Metaphysics Γ and Heraclitus fragments, sections 1–3 show how assumptions A1, A2, and A3 easily apply to Heraclitus. The case of the conclusion is more challenging. In the case of the Pluralists, the co-existence of opposites characterizes a state in which there is no generation. Such a view does not fit Heraclitus’ mobilism. To argue that Aristotle’s argument is general enough to encompass dynamic views, I examine his problematization of accepting the change of change in Metaphysics K and Physics V. There, after re-stating several points that appear in Metaphysics Γ, Aristotle argues that accepting the becoming of another becoming leads to a state of contradiction in which the becoming is perishing. Heraclitus’ B8, cited in Nicomachean Ethics, gives evidence that, for Aristotle, Heraclitus puts a process at the origin of an opposite process. Moreover, after examining the expression ‘living the death/dying the life’ in B62, I argue that Heraclitus was aware that his worldview implied a dynamic objective contradiction. Finally, an analysis of elemental changes in B36 proves that accepting objective contradictions does not make Heraclitus’ worldview less attractive. (shrink)

This paper critically investigates the implementation of the UN guiding principles on business and human rights (UNGPs) into the corporate setting through the concept of ‘translation’. In the decade since the creation of the UNGPs, little academic research has focussed specifically on the corporate implementation of human rights. Drawing on qualitative case studies of two multinational corporations—an oil and gas company and a bank—this paper unpacks how human rights are translated into the corporate context. In doing so, the paper focuses (...) on the “resonance dilemma” translators encounter, the strategies used to make human rights understandable and palatable, and the difficulties that emerge from this process. We contend that the process of making human rights understandable and manageable can change their form and content, which may act as an obstacle to human rights realisation and corporate accountability for human rights. In this study, we examine the accounts of 30 white middle- and upper-class female heroin/methadone users. Using a resistance framework, we note that these women recall their initial heroin use in ways that suggest rejection of restrictive gender and class expectations. Using a dynamic view of resistance, we begin to understand how these women attempt to resist the dominant discourse through their heroin use and to reinterpret their experiences with heroin.

Slightly modified excerpt from the section 13.4 Zusammenfassung und Ausblick (translated into englisch): This chapter is based on an analysis of ethical debates on epigenetics and genome editing, debates, in which ethical arguments relating to future generations and justice play a central role. The analysis aims to contextualize new developments in genetic engineering, such as genome and epigenome editing, ethically. At the beginning, the assumptions of "genetic determinism," on which "genetic essentialism" is based, of "epigenetic determinism" as well as "genetic" (...) and "epigenetic exceptionalism" are analyzed and critically discussed. The remarks on the ethical discourse on epigenetics show that the notion of "epigenetic determinism" can sometimes be discerned not only in popular scientific discourse but also in ethical discourse. Ethical debates on epigenetics, however, have distanced themselves from this deterministic understanding. As a result, the focus in the ethical discourse on epigenetics shifts from responsibility for one's own health and that of subsequent generations to justice. What is meant here is justice, for example, in terms of access to healthy environmental conditions, regardless of whether these contribute to health with or without epigenetic agency. An analysis of the discourse on genome editing reveals that it is primarily germline interventions that are being ethically examined, with a concentration on the aspect of inheritance. The question is whether this is accompanied by an implicit "genetic determinism" or even a "genetic essentialism": the determinism could lie in the centrality of the aspect of heritability, since only genetic information is inherited. Does the aspect of heritability and genome modification play a more decisive role in debates on genome editing than the safety issue? Is the problem of embryos and their potential offspring not being able to consent to germline intervention given such a high priority because it is a genetic intervention? Under such a premise of "strong genetic determinism" supplemented by "epigenetic determinism," not only genome editing but also epigenome editing would be ethically relevant precisely because it too would have an influence on the genome. How this influence of genome editing and epigenome editing is ethically evaluated in each case therefore depends initially on whether the assumptions of "genetic" and "epigenetic determinism" are advocated. These assumptions are increasingly viewed critically in ethical discourse because they cannot be confirmed from a scientific perspective. In popular scientific debates in particular, however, they seem to persist, which ultimately also influences the public discussion. This article presents an impact assessment framework that allows for the evaluation of positive and negative local-level impacts that have resulted from "responsible trade" interventions such as fair trade and ethical trade. The framework investigates impact relating to (1) livelihood impacts on primary stakeholders; (2) socio-economic impacts on communities; (3) organizational impacts; (4) environmental impacts; (5) policies and institutional impacts; and (6) future prospects. It identifies relevant local-level stakeholders and facilitates the analysis of conflicting interests. The framework was developed in (...) the context of, and is applied in this article to, the fair trade coffee industry in northern Nicaragua. It was designed, however, so that it can be applied across commodity sectors and responsible trade initiatives. It is able to do this by accommodating for differences in the social, environmental, political and institutional contexts of different areas, and by taking into account the distinct nature of an initiative's overall objectives, different levels of intervention, and the full range of stakeholders involved. Grammatical gender processing during language production has classically been studied using the so-called picture-word interference (PWI) task. In this procedure, participants are presented with pictures they must name using target nouns while ignoring superimposed written distractor nouns. Variations in response times are expected depending on the congruency between the gender values of targets and distractors. However, there have been disparate results in terms of the mandatory character of an agreement context to observe competitive gender effects and the interpretation of the (...) direction of these effects in Romance languages, this probably due to uncontrolled variables such as animacy. In the present study, we conducted two PWI experiments with European Portuguese speakers who were asked to produce bare nouns. The percentage of animate targets within the list was manipulated: 0, 25, 50, and 100%. A gender congruency effect was found restricted to the 0% list (all targets were inanimate). Results support the selection of gender in transparent languages in the absence of an agreement context, as predicted by the Gender Acquisition and Processing (GAP) hypothesis (Sá-Leite et al.,2019), and are interpreted through the attentional mechanisms involved in the PWI paradigm, in which the processing of animate targets would be favored to the detriment of distractors due to biological relevance and semantic prioritization. Children with developmental language disorder (DLD) served as a test case for determining the role of extant vocabulary knowledge, endogenous attention, and phonological working memory abilities in cross-situational word learning. First-graders (Mage = 7 years; 3 months), 44 with typical development (TD) and 28 with DLD, completed a cross-situational word-learning task comprised six cycles, followed by retention tests and independent assessments of attention, memory, and vocabulary. Children with DLD scored lower than those with TD on all measures of learning and (...) retention, a performance gap that emerged in the first cycle of the cross-situational protocol and that we attribute to weaknesses in initial encoding. Over cycles, children with DLD learned words at a similar rate as their TD peers but they were less flexible in their strategy use, demonstrating a propose-but-verify approach but never a statistical aggregation approach. Also, they drew upon different mechanisms to support their learning. Attention played a greater role for the children with DLD, whereas extant vocabulary size played a greater role for the children with TD. Children navigate the problem space of cross-situational learning via varied routes. This conclusion is offered as motivation for theorists to capture all learners, not just the most typical ones. Excerpt: 1. Introduction This chapter provides insight into the diverse ethical debates on genetics and epigenetics. Much controversy surrounds debates about intervening into the germline genome of human embryos, with catchwords such as genome editing, designer baby, and CRISPR/Cas. The idea that it is possible to design a child according to one’s personal preferences is, however, a quite distorted view of what is actually possible with new gene technologies and gene therapies. These are much more limited than the editing and (...) design metaphors suggest. Such metaphors are therefore highly problematic phrases in the context of new gene technologies, for two reasons. On one hand, to design a child of choice by modifying the genome would require modifying any gene of choice, which is more than can be done with current gene technologies, such as CRISPR/Cas. On the other hand, a modification of genes would need to be enough to create any characteristic of choice in the future child. The latter presupposes the assumption of genetic determinism. Moreover, the CRISPR/Cas technology can not only be used in a potentially therapeutic manner at the germline level. In addition, there is the (more likely) scenario of a future clinical therapeutic use of these new gene technologies for modifying the DNA sequence of other cells of the body (somatic genome editing). There is also the option of modifying the epigenome, that is, the spatial configuration of DNA (epigenome editing) (see table 1). Like genetics and genome editing, epigenetics has been at the center of recent popular scientific and ethical discourse as well as scientific debates. The concept of epigenetics has given rise to very different notions of inheritability and responsibility for health, which, however, are oftentimes based on scientifically controversial basic assumptions. That there continues to be covert genetic determinism in the form of epigenetic determinism (see table 2) in debates about epigenetics has been pointed out in ethical analyses of epigenetics. Neither genetic determinism nor epigenetic determinism has been confirmed scientifically. It is therefore important to recognize the concepts that are discussed (and sometimes harshly criticized) in debates about genome editing and epigenetics—for example, concepts about the causal role of DNA for our own life course. This importance is based on the fact that if we understand such controversial concepts, we will be able to remain critical when evaluating scientific knowledge and ethical arguments about genome editing and epigenetics. This chapter, therefore, explains some of these concepts. For an ethical analysis of epigenetics as well as of genome editing, it is necessary to understand and critically reflect upon the underlying concepts of genetic determinism and other, related -isms. The following section offers a detailed introduction to these -isms (section 2; see also table 2). Section 3 provides an ethical analysis of genome editing and epigenetics based on the explanations in section 2. Section 3 focuses on inheritability and responsibility, justice, safety, the problem of consent, and the effects of genome editing and epigenetics on embryos and future generations. This section does not discuss in detail further points that can be found in ethical debates about epigenetics as well as in ethical debates about genome editing. These points include (among others): • fear that the findings of epigenetics and that the methods of genome editing are misused—this also with respect to eugenics and enhancement; • naturalness—an issue we mention in passing a few times in the following analysis; • a possible connection between the genome/epigenome and the concept of human dignity, and the derived danger of instrumentalization and infringement of autonomy when intervening in the genome or epigenome. Since current discourse about ethical issues associated with genome editing focuses mainly on germline interventions, which are, for instance, interventions into a human embryo’s genome, we mainly focus on germline interventions when comparing the debates on genome editing and on epigenetics in section 3. O presente artigo tem por objetivo mostrar, desde a psicanálise freudiana, um caminho possível que a leva ao encontro da filosofia de orientação fenomenológica. Em O eu e o isso, de 1923, Sigmund Freud emprega uma nova noção pouco explorada na literatura psicanalítica: o eu-corpo. O escopo de nossa análise delimita-se à interpretação e à explicitação da noção de eu-corpo tal como esta foi apresentada por Freud, confrontando-a com a fenomenologia em Merleau-Ponty e Michel Henry. Para tanto, propomos uma análise (...) em quatro tempos. Inicialmente, evidenciaremos o entendimento de Freud sobre o modelo de psicologia originada em Brentano que tem como um de seus desdobramentos a fenomenologia. Depois, mostraremos como a concepção do isso, segundo o próprio texto de Freud, foi determinante para que ele formulasse uma revisão da primeira tópica e a incorporasse em uma segunda tópica. Por fim, nas últimas duas partes, examinaremos o tratamento dado por Merleau-Ponty e Michel Henry à questão do corpo. Concluímos que é possível o encontro entre a psicanálise e a fenomenologia via a noção de eu-corpo freudiano; contudo, tal condução implicará reformulações em teses centrais da psicanálise. (shrink)

Abstract: This working paper focuses on the question whether there is a therapeutic imperative that, in specific situations, would oblige us to perform genome editing at the germline level in the context of assisted reproduction. The answer to this central question is discussed primarily with reference to specific scenarios where preimplantation genetic diagnosis (PGD) does not represent an acceptable alternative to germline genome editing based on either medical, or ethical, or – from the perspective of the potential parents – moral (...) or religious grounds. This article deals with four different types of case constellations that result from these possible reasons against PGD as well as from the necessity or dispensability of a subsequent “control PGD.” These cases are discussed based on hypotheses concerning contextual factors and theoretical assumptions. In conclusion, we point out that if our assumptions are correct, there is probably no therapeutic imperative for genome editing at the germline level. We draw this rationale from the fact that germline interventions are likely not person-affecting. Die Antwort auf diese zentrale Frage wird insbesondere mit Bezug auf Fälle diskutiert, in denen das Verfahren der Präimplantationsdiagnostik (PID) keine aus entweder medizinischen oder ethischen oder – aus Sicht der potentiellen Eltern – moralischen bzw. religiösen Gründen akzeptable Alternative zu einem Keimbahneingriff darstellt. Die möglichen Gründe gegen die PID sowie die Erforderlichkeit oder Verzichtbarkeit einer nachfolgenden «Kontroll-PID» ergeben vier verschiedene Fallkonstellationen, denen sich der Beitrag zuwendet. Auf Grundlage von Hypothesen zu kontextuellen Faktoren und theoretischen Annahmen diskutieren wir diese Fälle. Im Ergebnis verweisen wir darauf, dass es, wenn unsere Annahmen zutreffen, vermutlich keinen therapeutischen Imperativ zum genome editing auf Keimbahnebene gibt. Dies begründet sich daraus, dass der Keimbahneingriff vermutlich nicht als personenbezogen (person-affecting) zu bezeichnen ist. Wir weisen jedoch darauf hin, dass unser Ergebnis vorläufig ist und unter Berücksichtigung der bioethischen Debatte und möglicher Einwände genauer geprüft werden muss. -/- // Résumé: Ce Working Paper se concentre sur la question de l’existence d’un impératif thérapeutique qui, dans des situations spécifiques, nous obligerait à réaliser une édition du génome au niveau de la lignée germinale dans le cadre de la procréation assistée. Afin de répondre à cette question centrale nous développons quatre scénarios spécifiques dans lesquels le diagnostic préimplantatoire (DPI) ne représente pas une alternative acceptable à l’édition du génome germinal pour des raisons médicales, éthiques ou – du point de vue des futurs parents – morales ou religieuses. Cet article traite de quatre constellations différentes de cas résultant des raisons mises en avant pour s'opposer au DPI ainsi que de la nécessité ou de l’inutilité d’un ultérieur « DPI de contrôle » Ces cas sont discutés sur la base d’hypothèses portant sur les facteurs contextuels et sur les présupposés théoriques. En conclusion, nous soulignons que si nos hypothèses sont correctes, il n’y a probablement aucun impératif thérapeutique justifiant l’édition du génome au niveau de la lignée germinale. Nous arrivons à cette conclusion parce qu’une intervention au niveau de la lignée germinale n’est probablement pas susceptible d’affecter la personne. Cependant, nous mettons en garde le lecteur sur le fait que notre conclusion est préliminaire et qu’elle doit être examinée avec soin dans des futurs travaux instruits par le débat bioéthique et par les éventuelles objections. This paper analyzes the problem of implication and attempts to characterize conditionals by a criterion of adequacy. A definition of implication based on the notion of limit of an infinite sequence is proposed.

Trata-se de uma contextualização filosófica que perpassa os limites e as fronteiras do pensamento reducionista: que fragmenta e exclui a subjetividade humana em nome da objetividade racionalista. Volta-se ao pressuposto de que tanto a subjetividade quanto a objetividade são legítimas fontes do pensar e do agir humanos e, por isto mesmo, fontes primárias da religação ética entre o eu e o outro. Debruçar-se sobre o conceito de amorosidade, em Paulo Freire, remete à discussão acerca da ética como campo ontológico das (...) relações entre humanos e humanos, e entre humanos e não humanos. A proposta que tangencia o estudo tem por objetivo principal compreender o conceito de amorosidade e seus desdobramentos dentro e fora da pedagogia freireana, sobretudo incorporada ao ethos e à racionalidade prática, nesta contemporaneidade. Almeja-se, com isto, oferecer algumas reflexões sobre o sentido e o sentir da amorosidade como modo de acolhimento do outro no eu, uma possibilidade de reconhecimento de um eu no outro. Following a discourse analysis approach this study examines triadic encounters of nine medical consultations carried out in an outpatient cancer clinic in Santiago, Chile involving an oncologist, a patient and a patient’s companion. Consultations are fully transcribed and analysed to understand the participatory roles patients’ companions play in the medical exchanges. In addition, the type of linguistic functions associated with each role and the advantages or downsides of companions’ involvement in the encounters are also investigated. The analysis reveals seven prominent (...) roles that companions may engage in during the visits. These are studied in detail. The results show that although companions may not always provide information that is consistent with the patients’ views, they can be of great help. Relieving the patients of many daunting tasks, monitoring their well-being, establishing a partnership and bringing vital information to the clinic are instances where the controlling power that some may exercise in the medical encounter can be outweighed. The article intends to show that MacIntyre’s notion of friendship (which, according to him, would be a reappropriation of Aristotle’s notion of philia), while ignoring the political aspect explicitly emphasized by Aristotle, reduces the notion of friendship to its social or civic aspect, thereby weakening the political nature of man.
